I understand that M2 Volleyball Club (“M2VBC”) and its owners, board members, managers, executives, employees, representatives, agents and contractors (collectively known as “Agents”) are not and shall not be liable in any event for any claims, liabilities, or expenses relating to you, the Athlete(s) named, or any guest you bring to M2VBC (any being a “Claimant”) for an aggregate amount in excess of the fees I have paid for the Athlete’s participation in the event(s) to any claim made by someone a Claimant is related to.
I agree to forever hold harmless M2VBC and its Agents from any and all liability, claims and demands for personal injury, sickness and death, as well as property damage and expenses of any nature whatsoever which may be incurred by me or the Athlete resulting from said Athlete’s participation in M2VBC events, including travel, recreation and all associated activities. Further, I hereby assume all risk of said personal injury, sickness, death, damage and expenses as a result of participation as above set forth. Moreover, I hereby acknowledge and agree I have no claim (“Claim”), whether in a court of law, with SRVA, with any other regulatory agency or otherwise (any “Agency”), against M2VBC or its Agents from any priority activity and involvement of any Claimant prior to the date hereof, including any M2VBC team-related activities not at M2VBC’s location. I agree not to make any Claim against M2 Volleyball Club to any Agency.
In the event of emergency, injury or illness, I authorize agents of M2VBC in a reasonable manner to act in the Athlete’s interest on my behalf and hereby release them from all liability related to doing so. I fully acknowledge and agree that it is my responsibility to inform M2VBC in writing of any medical conditions or existing injuries that may affect the Athlete’s full participation in any M2VBC event.
I release all information submitted to M2VBC for use as part of an information database for M2 Volleyball Club, M2 Volleyball Academy, and other M2VBC affiliates. Additionally, I grant the unrestricted rights to use, alter, and reproduce any images (still and video) of the Athlete from any M2VBC event, in any medium, without compensation.
I acknowledge and agree that participation in and association with M2 Volleyball Academy camps, clinics, training, or other events does not in any way impact decisions made by M2VBC with respect to playing time or team placements and does not satisfy any try-out requirement.
I acknowledge and agree that M2VBC coaches may yell or otherwise significantly raise their voice when coaching players, including Claimant, and if I do not like or agree with this or anything other behaviors exhibited by an M2VBC coach does, my and the Claimant’s only remedy at law or otherwise is to stop playing for, training at or training with M2VBC.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19:
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
M2 Volleyball Club (“the Club”) has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.
By agreeing to these terms, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.
